When NYC Requires a Roofing Permit
New York City requires a Department of Buildings permit for roof replacements. Full tear-off and replacement is a structural alteration in the eyes of the DOB, and it requires a permit.
Roof repairs (patching a section, replacing flashing, resealing a drain) generally do not require permits unless they're part of a larger scope of work. When in doubt, we pull the permit. The downside of an unnecessary permit is some paperwork. The downside of skipping a required permit is significant.
What Happens If You Skip the Permit
Unpermitted work creates problems at sale time. Title searches and buyer's attorneys increasingly look for permit history. An unpermitted roof replacement can require demolition and re-inspection, or significantly complicate a closing.
Insurance claims can also be affected. If your insurance company discovers the roof was replaced without permits and inspections, it can complicate or deny a claim related to the roof.

Before hiring a roofing contractor, ask: "Will you pull the permit?" A contractor who says permits aren't necessary for a full roof replacement in NYC is either uninformed or planning to cut corners. Neither is acceptable.
